Conformity assessment in Eurasian Economic Union


In the territory of the Customs Union certain evaluation criteria are in action for the products - the requirements of technical regulations (TR).
Depending on the requirements of specific technical regulations of CU, a declaration of conformity or certificate of conformity of goods is prepared.
Those two forms are different in the level of responsibility. When preparing the certificate of conformity TR, the responsibility for violating the terms of product manufacturing, its safety and sale lies with the holder of the certificate of conformity TR and certification body that prepared the document.
When preparing a declaration of conformity, all the responsibility lies directly with the person who received the document, i.e. holder of the declaration.



TR CU Certificate of Conformity Certificate of conformity - a document certifying the conformity of the object with the technical regulations, provision of standards, codes of practice or the terms of contracts.
Technical Regulations of the Customs Union (hereinafter – CU technical regulations) – is a legislative act, defining the mandatory requirements for the production process, materials, labeling, sale, as well as conditions required for the storage of different categories of products.
To obtain a certificate of technical regulations, the applicant must provide product documentation, as well as samples for study in the laboratory.
Based on the results of laboratory tests a decision is made on conformity or non- conformity of products with technical regulations.


The main stages of certification:

 

  • submitting an application
  • developing and coordinating the work plan with an applicant
  • analysis of the documents submitted
  • testing of product samples in the laboratory
  • issuance of a report on test results
  • preparing the certificate, if the tests have been successful
  • issuance of certificate

 

TR CU Declaration of Conformity

 

In assessing conformity, the applicant may be a legal entity or a natural person, registered as an individual entrepreneur in the territory of a Member State in accordance with its law, who is a manufacturer or a seller or a person authorized by the manufacturer.
Above mentioned document is not prepared in the name of the foreign producer.
If TR CU declaration is required for a mass production abroad then the applicant can only be a legal entity or an individual entrepreneur, registered in the territory of the Customs Union.
To confirm that the product meets the requirements of specific technical regulations, a certain documentation package should be provided. The basis for the registration of TR declaration is an application submitted to a special certification body which has the right to assess product conformity with specific technical regulations.
The procedure for registration of the declaration suggests using one’s own evidence base as well as engaging a third party to confirm that the products meet the requirements of TR. A declaration of conformity with technical regulations is usually prepared on a regular white A4 paper.
The effective date of the declaration of conformity is set by the applicant, unless otherwise provided by the technical regulations of the Customs Union for certain types of food products.
Integrated registers of issued and received documents on conformity assessment are posted on the official website of the Union.

For commercially available domestic products

 

  1. Application for registration of a declaration of conformity
  2. A copy of the certificate of state registration of legal entity in accordance with the laws of the member states of the Customs Union
  3. Copy of certificate of registration with tax authorities
  4. A copy of the normative document for manufactured product
  5. Notification about the beginning of the production (or a document replacing it))
  6. Manufacturer's declaration (or certificate) on conformity of production with procedures based on the principles of HACCP (commercial production) (or GMP - for Perfume & Cosmetics products)
  7. Information provided by paragraphs 4 and 5 of Article 10 TP TC 029/2012 (for food additives, flavorings and auxiliary substances)
  8. Test reports (or product samples for testing)
  9. Labels or their layouts designed in accordance with the requirements of TR CU 022/2011 "Food labeling" (or TR CU 009 / 2011- for perfume and cosmetic products)
  10. Documents, confirming the safety of raw materials and packaging materials
  11. Copy of certificate of state registration / if required for the product /

For imported products

 

  1. Application for registration of a declaration of conformity

  4. A copy of the contract with a foreign applicant, ensuring conformity of delivered products with the technical regulations of the Customs Union, and the responsibility for non-conformity of supplied products to specified requirements of the Customs Union (commercial production)
  5. Manufacturer's declaration (or certificate) on conformity of production with procedures based on the principles of HACCP (commercial production) (or GMP - for Perfume & Cosmetics products)
  6. A veterinary certificate of origin, and the veterinary certificate of the Republic of Armenia (for processed animal products)
  7. A phytosanitary certificate of origin and quarantine permission for import of the Republic of Armenia (for plant products)
  8. Ingredient composition (for cosmetics)

Declaration of Conformity


Legal entities and individual entrepreneurs involved in manufacture and import has the right to apply for a declaration of conformity.
Declaration is approved and registered by certification body within the scope of its accreditation.

 

The certification body prior to ratifying the declaration checks:

 

  • an applicant's eligibility to apply for declaration
  • Availability of all normative documents for product conformity assessment and their accuracy in declaration.
  • Availability of required documents specified for products in accordance with scheme
  • Correctness of filled declaration
  • A declaration of conformity is prepared on a regular A4 paper.

 

 

The list of documents required for the adoption of declaration

 

 

  • A general description of the product
  • design data, drawings, diagrams, technical terms
  • technical regulations and procedures to ensure compliance of product with standards used fully or partially
  • design calculations, results of inspections and testing protocols
  • Protocol for analysis carried out in accredited analytical laboratory of each product batch, standard samples or any analyzed unit, if required by the scheme.
  • Quality management system certificate of conformity
  • Documents, hygienic conclusions, veterinary and phytosanitary certificates etc issued by the authorized government bodies provided for the products by the law of RA /
  • Period of validity of declaration is specified by the applicant, according to regulatory documents, however that period cannot exceed 3 years.
  • All payments associated with the ratification of declaration and registration activities are done by the applicant in accordance with the procedure defined by the RA Government.
